1. Acceptance of Terms
By accessing or using any part of the Accessibird platform — including the website at https://accessibird.com, the application dashboard at https://app.accessibird.com, the widget at https://widget.accessibird.com, the embeddable accessibility widget, APIs, edge functions, or any related services (collectively, the "Service") — you agree to be bound by these Terms of Service (the "Terms").
If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization. In that case, "you" refers to that organization.
For the purposes of these Terms, "Accessibird" refers to the Service, product, and brand, and to Accessibird Limited, the legal contracting entity responsible for providing the Service.
The contracting party for the Service is Accessibird Limited, a company registered in Hong Kong, with its registered address at Unit 1801, 18th floor, Fortis Tower, 77 Gloucester Road, Wan Chai, Hong Kong.
From the effective date of this version, all existing agreements for the Service previously concluded with Turtle Works B.V. are transferred to Accessibird Limited.
Accessibird Limited is fully responsible for the provision of the Service and for all obligations under these Terms.
If you do not agree to these Terms, you must not use the Service.
2. Description of Service
Accessibird is a web accessibility platform that provides tools for accessibility monitoring, analysis, and user interface adjustments.
2.1 Accessibility Widget
A client-side JavaScript widget that enables users to adjust presentation and interaction of a website in real time, including assistive features such as contrast modes, font scaling, and navigation aids.

A web-based application to:
- Register and manage websites
- Configure widget behavior and appearance
- View analytics and usage data
- Manage accessibility findings
- Generate reports
2.3 Accessibility Scanning

- Detection of accessibility issues
- Reporting and trend tracking
- Scheduled scans
2.4 Agency Features
- Multi-site management
- Team access and roles
- Agency branding capabilities (custom colors, styling, and client-specific configuration; Accessibird branding remains visible)
- Client onboarding workflows
3. Accessibility Positioning
Accessibird is designed to support accessibility improvements.
However:
- The Service is an assistive tool
- It does not replace full accessibility remediation
- It does not guarantee compliance
You remain responsible for the accessibility of your website.
4. Eligibility
You must be at least 16 years old, or the legal age of digital consent in your jurisdiction, to use the Service.
5. Accounts
5.1 Account Creation
You must provide accurate information and maintain its accuracy.
5.2 Responsibilities
You are responsible for:
- Account security, including safeguarding login credentials and access
- All activity under your account, whether performed by you or by others using your credentials
5.3 Restrictions
- One account per user unless explicitly authorized
- Automated account creation is not allowed
6. Pricing & Subscriptions
6.1 Plans
The Service offers a Free plan and paid plans (Pro and Business). Enterprise is a sales-assisted plan with a price quoted on request. The Free plan is provided at no monetary cost, subject to defined usage limits, feature restrictions and availability. The current plans, prices and limits are shown on the pricing page at https://accessibird.com/pricing.
6.2 Free Trial
Eligible websites may try a paid plan free of charge for 14 days, without entering payment details. If you do not upgrade before the trial ends, the website returns to the Free plan.
6.3 Billing and Payment
Paid plans are billed in advance, monthly or yearly, in euro, plus VAT where applicable. Prices shown in US dollars are indicative only. Payments are processed by Paddle.com, which acts as reseller and merchant of record for paid plans, and Paddle's buyer terms apply to the purchase.
6.4 Cancellation and Refunds
Cancellation. You may cancel a paid plan at any time from the billing page in the app. The plan stays active until the end of the current paid period, after which the website returns to the Free plan. No further payments are taken after cancellation.
14-day refund on the first payment. If you are not satisfied, you can request a full refund within 14 days of the first payment for a paid plan, for monthly and yearly plans alike.
After 14 days. Payments are not refunded after the 14-day period. This includes renewals and yearly plans cancelled partway through the year: a yearly plan stays active until the end of the paid year, and unused months are not refunded.
Billing errors. Duplicate charges, charges after a confirmed cancellation, and other billing errors are always refunded.
How to request a refund. Email support@accessibird.com with your invoice or transaction number, or contact Paddle through paddle.net. Approved refunds are paid by Paddle to the original payment method, usually within 5 to 10 business days.
Nothing in this section limits rights you have under mandatory consumer protection law.
6.5 Price Changes
Accessibird may introduce, adjust or discontinue plans and usage-based pricing. At least 30 days' notice will be provided before a new price applies to you, and it applies from your next billing period.
6.6 No Guarantee
Free access to any given plan is not guaranteed indefinitely.
6.7 Per-Website Subscriptions
Subscriptions are sold and enforced per website, not per account. Each website you register independently carries its own tier, trial eligibility, quotas, feature access, and retention window. A single account may hold any mix of free and paid websites at the same time.
There is no account-level pooling of subscription cost or capability across websites. Upgrading, downgrading, cancelling, or trialing a tier applies to the specific website you selected and does not automatically change the tier of any other website in your account.
For agency accounts, agency-scope limits (such as the number of client organizations an agency may manage) are governed by a separate agency subscription. Websites managed for clients still carry their own per-website subscription, held by the account that owns the website.
6.8 Automated Tier Qualification
Accessibird uses automated and AI-assisted mechanisms — collectively "AI Tier Qualification" — to continuously evaluate whether the subscription tier of each of your websites fits its organisation, operational complexity, and expected service needs. This evaluation runs on a schedule configured by Accessibird and may be re-run when the qualification result becomes stale.
AI Tier Qualification produces a recommended tier and a fit indication (for example, "correct", "too small", or "too big"). You acknowledge and agree that:
- Accessibird may share this recommendation with you in the Service and may contact you to discuss persistent material mismatch between the recommended and current tier.
- The recommendation is guidance only. Accessibird does not, under these Terms, automatically downgrade your website, refuse renewal, or migrate your subscription based solely on AI Tier Qualification output.
- Any future introduction of enforcement (such as refuse-renewal or automatic migration) based on AI Tier Qualification will require an explicit update to these Terms and prior notice per §16.
- Websites on the Enterprise tier are not routinely re-qualified, as Enterprise is a sales-assisted tier.
- Accessibird may retain the qualification result, its inputs, its confidence score, and its rationale for internal analysis, sales support, and audit.
7. Acceptable Use
You agree not to:
- Violate applicable laws or regulations, including accessibility, privacy, and data protection laws
- Reverse engineer or attempt to extract source code, except where permitted by law
- Abuse scanning infrastructure, such as excessive automated requests or attempts to overload or bypass system limits
- Scrape or harvest data outside documented APIs, including automated extraction of data not intended for public or authorized use
- Bypass security or rate limits, including attempts to circumvent technical safeguards
- Use the Service without authorization, including accessing accounts, data, or features without proper permission
- Resell the Service without agreement, including offering it as part of a competing or standalone product
- Attempt unauthorized access to data or accounts, including other users' information or system components
Accessibird may suspend or terminate accounts for violations.
8. Intellectual Property
8.1 Ownership
Accessibird retains all rights to the Service, including:
- Software, APIs, and infrastructure
- Widget implementation

8.2 Your Data
You retain ownership of your website content and configuration data.
8.3 License
You grant Accessibird a limited license to process your data solely to provide the Service.
9. Data & Privacy
Processing is GDPR-aligned and hosted on EU-based infrastructure. The widget is designed with privacy in mind and does not collect personally identifiable information (PII). See the Privacy Statement for details.
10. Service Availability
The Service is provided on a best-effort basis. Accessibird does not guarantee uninterrupted availability and may schedule maintenance windows or introduce changes with reasonable notice where practicable.
11. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied.
12. Limitation of Liability
To the maximum extent permitted by law, Accessibird's aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount paid by you to Accessibird in the twelve months preceding the claim, or (b) one hundred euros (€100).
13. Indemnity
You agree to indemnify and hold Accessibird harmless from any claim arising from your misuse of the Service, your violation of these Terms, or your infringement of third-party rights.
14. Termination
You may terminate your account at any time. Accessibird may suspend or terminate access for violations of these Terms or for operational reasons, with reasonable notice where practicable.
15. Governing Law
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Disputes are submitted to the courts of Hong Kong. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.
16. Changes to Terms
Accessibird may update these Terms from time to time. Material changes will be announced with at least 30 days' notice where practicable, and continued use of the Service after the effective date of the updated Terms constitutes acceptance.
